Wesley Chapel car accident lawyer

Wesley Chapel crashes happen where the interstate ramps meet the plazas: exits 275, 279 and 282, the SR-56 diverging diamond, and the left turns on Bruce B. Downs. Conde-Huggins handles them from Port Richey and meets you in Wesley Chapel.

Wesley Chapel was built around an interstate, and its car accidents follow the ramps. A driver merges from SR-56 into 70-mile-an-hour traffic at exit 275. A left-turning SUV misjudges a gap on Bruce B. Downs Boulevard outside the hospital. A commuter who has never seen a diverging diamond interchange freezes in the crossover. These are the crashes Conde-Huggins Accident Injury Lawyers handles for Wesley Chapel residents, from an office on Ridge Road in Port Richey that comes to you.

Where car accidents happen in Wesley Chapel

The three I-75 interchanges. Exit 275 at SR-56 is the diverging diamond that opened on May 1, 2022. Exit 279 is Wesley Chapel Boulevard, the county road that becomes SR-54 just east of the ramps. Exit 282 at Overpass Road opened on January 18, 2023, a $64.4 million interchange built to pull traffic off the other two. Each one dumps interstate traffic onto a surface road within a few hundred feet of a signal, and the collisions at the bottom of the ramps are the ones that fill our Wesley Chapel files.

The diverging diamond. At SR-56 the through lanes cross to the left side of the road, pass under I-75, and cross back. It moves more cars with fewer conflict points, but only for drivers who understand it. Visitors heading to the outlet mall often do not. Late lane changes inside the crossover and drivers who stop where they should proceed produce sideswipes and rear-end chains at the signals.

Bruce B. Downs Boulevard. From the county line north past AdventHealth and the SR-56 signal, then through Seven Oaks past BayCare toward SR-54, Bruce B. Downs is a wide divided arterial with a median opening or a signal every few hundred yards. Left turns across three lanes of fast traffic are the signature crash.

SR-54 east of I-75 and Wesley Chapel Boulevard. SR-54 is six lanes until a point east of Curley Road, where it drops to two undivided lanes toward Zephyrhills. The transition catches drivers who are still traveling at six-lane speeds. Wesley Chapel Boulevard, CR 54, curves between SR-56 and the exit 279 ramps past Saddlebrook, the signal at Progress Parkway and the Oakley Boulevard intersection, and Pasco County has been widening it to six lanes.

Wesley Chapel's population grew from about 44,000 in 2010 to nearly 65,000 in 2020. The subdivisions off Overpass Road and Curley Road keep adding cars to roads designed for a smaller town.

What makes a Wesley Chapel car accident claim different

Three things come up here more than in west Pasco.

Out-of-area drivers. I-75 carries Georgia, Ohio and Michigan plates every day, and many Wesley Chapel residents moved from states that require bodily injury liability coverage and assume Florida does too. It does not. Florida requires only $10,000 in PIP and $10,000 in property damage liability. The driver who hit you may have no coverage for your injuries at all, which is why your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 is the first policy we read.

Multi-vehicle crashes. Ramp and crossover collisions often involve three or four cars. Each driver's insurer blames the others, and the first version told to an adjuster tends to stick. We get the FHP diagram, the event data from every vehicle that will give it up and the video from the plazas at the ramps before anyone's story hardens.

Two hospitals with two sets of records. AdventHealth Wesley Chapel at 2600 Bruce B. Downs Boulevard and BayCare Hospital Wesley Chapel at 4501 Bruce B. Downs Boulevard, about two miles north in Seven Oaks, both take crash patients. Patients are sometimes seen at one and followed up at the other, or transferred to a Level I trauma center in Tampa. We collect every record so the chart tells one continuous story.

If any of that sounds like your crash, call (240) 421-5511. We will tell you in one conversation what the insurance picture looks like.

The Florida rules that decide a Wesley Chapel claim

The 14-day rule and the $2,500 trap. Your own PIP policy pays 80 percent of medical bills and 60 percent of lost income up to $10,000 regardless of fault, but only if initial treatment begins within 14 days of the crash (Fla. Stat. § 627.736). Unless a physician, physician assistant, dentist or nurse practitioner documents an emergency medical condition, the medical benefit is capped at $2,500. An emergency room visit on Bruce B. Downs the day of the crash usually takes care of both. If you went home from the scene, go now.

The permanent-injury threshold. To recover pain and suffering from the at-fault driver, Fla. Stat. § 627.737(2) requires a permanent injury within a reasonable degree of medical probability, significant and permanent scarring or disfigurement, permanent loss of an important bodily function, or death. Interstate-speed crashes often qualify. The finding has to come from your doctors, and we make sure it is asked for and answered.

The 51 percent bar. Florida's modified comparative negligence rule, Fla. Stat. § 768.81(6), reduces your recovery by your share of fault and eliminates it if your share is more than 50 percent. A ramp merge or a crossover collision is exactly the kind of crash where an adjuster tries to put you at 51. The evidence we preserve in the first week is the answer.

Two years. For crashes after March 24, 2023, a negligence suit must be filed within two years under Fla. Stat. § 95.11(5)(a). Claims against Pasco County, GOPasco or the school board require written notice first under Fla. Stat. § 768.28(6).

Who investigates, and where the case is heard

Wesley Chapel has no police department. The Florida Highway Patrol, Troop C, works the interstate, SR-54, SR-56 and most serious crashes on Bruce B. Downs. The Pasco Sheriff's Office responds to many crashes on subdivision streets and generally writes a short-form report without a diagram or narrative. We obtain whichever report exists through the Florida Crash Portal during the 60-day confidentiality period under Fla. Stat. § 316.066(2) and build the rest of the file ourselves.

If a lawsuit is necessary, Wesley Chapel cases are typically filed in Pasco County at the Robert D. Sumner Judicial Center, 38053 Live Oak Avenue in Dade City. Clementine Conde has practiced in Florida courts since 1992 and appears in both Pasco courthouses.

What we do in the first week

  1. Send preservation letters to the other driver's insurer and to the businesses at the ramps and plazas whose cameras may have recorded the crash.
  2. Confirm every policy in play: the other driver's bodily injury limits, your PIP, your UM/UIM, and any umbrella or resident-relative policy in your household.
  3. Open your PIP and property damage claims so the adjuster calls us instead of you.
  4. Check the emergency department record for the emergency medical condition finding and arrange follow-up care with a physician.
  5. Request 911 audio and the FHP long-form report.

By day seven you have one point of contact and the insurers have a lawyer to deal with. Call (240) 421-5511 to start.

Questions people ask us about wesley chapel car accident cases

I was hit inside the diverging diamond at I-75 and SR-56. Who is at fault when the lanes cross over?

The same rules apply as at any other signalized intersection: the driver who ran the crossover signal, drifted out of the marked lane or changed lanes inside the crossover is at fault. The unusual layout does not excuse anyone. FHP's diagram, the signal timing records FDOT keeps for the interchange and video from the businesses at the ramps usually settle it. Under Fla. Stat. § 768.81(6) your recovery is reduced by any share of fault assigned to you and barred above 50 percent, so do not guess at what happened when the adjuster calls.

The driver who rear-ended me on I-75 lives in Georgia. Can I still bring a Florida claim?

Yes. The crash happened in Pasco County, so Florida law governs and a lawsuit would be filed here. The practical difference is that the driver's insurer may be unfamiliar with Florida's PIP and permanent-injury rules, and the driver may carry limits very different from a Florida policy. We put the out-of-state carrier on notice immediately, confirm the bodily injury limits in writing and open a claim on your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 at the same time.

My crash was on Bruce B. Downs Boulevard. Was that Pasco County or Hillsborough County?

Bruce B. Downs crosses the county line south of SR-56. The two hospitals, the Wiregrass shopping district and everything north of there is Pasco; the New Tampa side is Hillsborough. The county decides which sheriff's office may have responded and which courthouse hears a lawsuit, but not the law that applies. Tell us the nearest cross street and we will know in a minute.

Do I have to drive to Port Richey to hire you?

No. We meet Wesley Chapel clients at AdventHealth Wesley Chapel, at BayCare Hospital Wesley Chapel, at home, or at a coffee shop on SR-56 if that is easier. After the first meeting almost everything moves by phone, text and email. The consultation is free and there is no attorney's fee unless we recover compensation for you.

How long do I have to sue after a Wesley Chapel car accident?

Two years from the date of the crash for a negligence claim arising after March 24, 2023, under Fla. Stat. § 95.11(5)(a). If a GOPasco bus, a county truck or a school board vehicle was involved, written notice under Fla. Stat. § 768.28(6) must be given first and the claim is capped at $200,000 per person. The evidence that wins these cases, including plaza video and vehicle data, lasts weeks, not years.
