Lutz has one main street and two counties. US-41 runs through the middle of it, from the old depot at Lutz-Lake Fern Road in Hillsborough north across the county line to the SR-54 signal in Pasco. Dale Mabry Highway merges into US-41 just past that line. Van Dyke Road connects Dale Mabry, the hospital and the Suncoast Parkway. Depending on where on those roads a crash happens, a different sheriff may respond and a different courthouse may hear the case, and the drivers involved rarely know which.

Conde-Huggins Accident Injury Lawyers is a Pasco County firm based on Ridge Road in Port Richey that handles car accident claims on both sides of the Lutz line. We meet clients at St. Joseph's Hospital-North or at home. Call (240) 421-5511 for a free consultation. No attorney's fee unless we win.

Lutz car accidents, road by road

US-41 at SR-54. The Pasco end of Lutz, where Land O' Lakes Boulevard meets the main east-west road of south Pasco. Heavy left-turn volume, plazas on every corner, and the red-light crashes that come with long cycles.

The Dale Mabry merge. Dale Mabry Highway, SR-597, runs north from Tampa through a rural stretch beyond the Veterans Expressway and ends by merging into US-41. Drivers carrying Dale Mabry speed onto a two-way highway with driveways produce rear-end and sideswipe crashes at the merge and at the first signals north of it.

US-41 through the town center. Lutz-Lake Fern Road, the schools, the churches and the plazas all open onto US-41 at highway speed. The left turn across traffic into a driveway is the recurring crash.

Van Dyke Road. The route to St. Joseph's Hospital-North and to the Suncoast Parkway, two lanes in places and carrying hospital, school and commuter traffic that uses it to avoid the highways.

I-275 and I-75. The interstates on the east side are FHP territory and high-speed. A crash there with a driver from out of the area raises insurance questions on day one.

One claim, two sets of agencies

Lutz has no police department. The Florida Highway Patrol, Troop C, covers both Pasco and Hillsborough and investigates most serious crashes on US-41, SR-54, Dale Mabry and the interstates. On local roads the responding agency depends on the county: the Pasco Sheriff's Office north of the line, the Hillsborough County Sheriff's Office south of it.

That difference shows up in the file. The Pasco Sheriff's Office generally does not complete long-form crash reports, so a Pasco-side crash worked by a deputy may come with a single page and no diagram. We do not rely on the report in either county. We photograph the scene, request 911 audio, canvass the plazas on US-41 for video and interview witnesses while they still remember. Reports from any agency are confidential for 60 days except to the parties, their attorneys and insurers under Fla. Stat. § 316.066(2), and we obtain them.

If the case has to be filed, a Pasco-side crash goes to the Pasco courts and a Hillsborough-side crash goes to Tampa. Clementine Conde has practiced in Tampa Bay courts since 1992 and handles both.

Florida rules that apply on both sides of the line

PIP and the 14-day rule. Your own personal injury protection pays 80 percent of medical bills and 60 percent of lost income up to $10,000 regardless of who caused the crash, but only if initial treatment begins within 14 days (Fla. Stat. § 627.736). The medical benefit is capped at $2,500 unless a physician, physician assistant, dentist or nurse practitioner documents an emergency medical condition. St. Joseph's Hospital-North at 4211 Van Dyke Road is the nearest emergency department for most of Lutz; the Pasco side near SR-54 is also close to AdventHealth Wesley Chapel and BayCare Hospital Wesley Chapel.

The permanent-injury threshold. Fla. Stat. § 627.737(2) allows pain and suffering against the at-fault driver only for a permanent injury within a reasonable degree of medical probability, significant and permanent scarring or disfigurement, permanent loss of an important bodily function, or death. Your treating physicians answer that question, and we make sure they are asked.

The 51 percent bar. Under Fla. Stat. § 768.81(6), a driver found more than 50 percent at fault recovers nothing, and a smaller share reduces the award. Merge crashes at Dale Mabry and left-turn crashes on US-41 are the disputed-fault cases where the adjuster's first call matters most. Do not give a recorded statement before you talk to us.

UM/UIM. Florida requires only PIP and property damage liability, so the other driver may have no coverage for your injuries. Uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 on your policy or a resident relative's is often what pays, and we review every policy in your household.

Two years. A negligence suit must be filed within two years of the crash under Fla. Stat. § 95.11(5)(a), in either county. Claims against a county or school board need written notice under § 768.28(6) first and are capped at $200,000 per person.

What we do in the first days

  1. Meet you at St. Joseph's Hospital-North, a Wesley Chapel hospital, a Tampa trauma center or your home.
  2. Identify the county, the agency and the report number from your exchange slip, and order the report.
  3. Send preservation letters to the other driver's insurer and the businesses whose cameras face US-41, SR-54 or Van Dyke Road.
  4. Open your PIP and property damage claims so you stop taking adjuster calls.
  5. Read every declarations page in your household and confirm the other driver's limits in writing.
  6. Follow your treatment, and make the demand when your doctors know what your injuries are.

Questions people ask us about lutz car accident cases

I was hit where Dale Mabry merges into US-41. Which county was that, and which sheriff has the report?

Dale Mabry Highway ends by merging into US-41 just north of the Pasco County line, so a crash at the merge itself is in Pasco and a crash a half mile south is in Hillsborough. FHP Troop C covers both and works most serious crashes on either road; otherwise the Pasco Sheriff's Office responds north of the line and the Hillsborough County Sheriff's Office south of it. The exchange slip from the scene names the agency. Any agency's report is sold through the Florida Crash Portal for $10 plus a $2 fee.

If my Lutz crash was on the Hillsborough side, can a Pasco County firm still handle it?

Yes. Florida law is the same in both counties, and our attorney has practiced in Tampa Bay courts since 1992. What changes is where a lawsuit would be filed: a Hillsborough crash goes to the circuit court in Tampa, a Pasco crash to the West Pasco Judicial Center on Little Road or the Robert D. Sumner Judicial Center in Dade City. Most cases resolve before suit, and the investigation, the insurance claims and the medical documentation are identical either way.

I went to St. Joseph's Hospital-North the night of the crash. Does that satisfy the PIP rules?

The emergency department visit satisfies the 14-day initial-treatment requirement in Fla. Stat. § 627.736. The second requirement is an emergency medical condition documented by a physician, physician assistant, dentist or nurse practitioner, which raises the PIP medical benefit from $2,500 to $10,000. An ER record usually contains that finding, and we read the chart to confirm it. Follow up with a physician afterward so the record of your injuries is continuous.

The driver who rear-ended me on SR-54 has only PIP and property damage coverage. Where does my compensation come from?

From your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727, if you or a relative in your household carries it, and from any umbrella policy in the house. Florida does not require bodily injury liability coverage, so this situation is common on SR-54. We also check whether the driver was working, which brings in an employer's commercial policy, and who owned the vehicle, because the owner is liable under Florida's dangerous instrumentality doctrine.

How long do I have to file a lawsuit after a Lutz car accident?

Two years from the crash under Fla. Stat. § 95.11(5)(a) for crashes after March 24, 2023, in either county; earlier crashes keep the four-year period. Wrongful death is two years under § 95.11(5)(e). A claim against Pasco County, Hillsborough County or a school board requires written notice under Fla. Stat. § 768.28(6) before suit. Plaza video on US-41 lasts days, so the practical deadline is this week.
