I-75 freight meets a growing town.

Wesley Chapel truck accident lawyer

Long-haul trucks on I-75 and the dump trucks building Wesley Chapel share the same ramps and signals with 65,000 residents. When one of them causes a crash, the evidence has a short shelf life. Conde-Huggins moves first.

The Florida Highway Patrol works a steady stream of commercial vehicle crashes on the stretch of I-75 between the SR-56 and SR-52 interchanges. The interstate is the freight route between Tampa and everything north, and in Wesley Chapel it meets local traffic at three interchanges, one rebuilt as a diverging diamond in 2022 and one brand new in 2023. Add the dump trucks, concrete mixers and lumber flatbeds serving subdivisions from Overpass Road to Curley Road, and Wesley Chapel carries a heavy share of the county's truck traffic.

Conde-Huggins Accident Injury Lawyers represents people hurt by those trucks. Our office is on Ridge Road in Port Richey; our clients are in Wesley Chapel, and we come to them. Call (240) 421-5511 for a free consultation. No attorney's fee unless we win.

Three interchanges, three kinds of truck crash

Exit 275, SR-56. The diverging diamond that opened in May 2022 moves traffic efficiently, but a tractor-trailer needs the full crossover lane and a wide swing to make the ramp. Cars that squeeze alongside a turning semi in the crossover end up under its trailer. Off the ramp, SR-56 feeds the outlet mall and the Wiregrass shopping district, where delivery trucks back into loading docks a few feet from pedestrian crossings.

Exit 279, Wesley Chapel Boulevard and SR-54. This is the older interchange, and the one where through-trucks bound for Zephyrhills leave the interstate for the two-lane section of SR-54 east of Curley Road. A loaded truck on a two-lane road with no passing zones and driveways every few hundred feet is a rear-end and head-on risk at the same time.

Exit 282, Overpass Road. Opened in January 2023 specifically to serve the new development on the east side. Overpass Road is four lanes west of the interstate to Old Pasco Road and six lanes east to Boyette Road, and the construction haulers use it all day. Fill-dirt trucks are frequently overloaded, top-heavy and driven on tight schedules.

Between the interchanges, the interstate itself produces the worst crashes: a semi that fails to slow for stopped traffic, a lane change into a car in the blind spot, a tire failure at highway speed. The Pasco Metropolitan Planning Organization names I-75 among the corridors where the county's fatal crashes cluster.

Why the first week decides a Wesley Chapel truck case

A truck crash is different from a car crash because the truck keeps records and the carrier knows how to make them disappear lawfully.

  • Electronic logging device data showing the driver's hours must be kept by the carrier for only six months under federal rules.
  • Engine control module data recording speed, braking and throttle before impact can be overwritten once the tractor is repaired and returned to service.
  • Dash camera footage loops over itself on a schedule set by the carrier.
  • Dispatch messages, bills of lading and weight tickets show whether the load was legal and the schedule was possible.

None of it has to be preserved for you unless someone demands it in writing. Conde-Huggins sends a spoliation letter to the carrier, its insurer, the owner of the tractor and the owner of the trailer within days of being retained. A company that destroys evidence after that letter answers for it in court. If you were hit by a truck in Wesley Chapel last week, call (240) 421-5511 today. The clock on the logs is already running.

Who can be held responsible

Rarely just the driver. Depending on the crash, the responsible parties can include the motor carrier whose USDOT number is on the door, the separate company that owns the trailer, a freight broker that hired a carrier with a known bad safety record, the shipper that overloaded or failed to secure the cargo, a maintenance contractor that passed bad brakes, and, for construction haulers, the developer or contractor that set the schedule. Under Florida's dangerous instrumentality doctrine the owner of the vehicle is generally liable for a permissive driver's negligence, and Florida adopts the federal motor carrier safety rules for in-state carriers through Fla. Stat. § 316.302.

If the truck belonged to Pasco County, the school district or GOPasco, the claim falls under Fla. Stat. § 768.28: written notice before suit, a $200,000 per-person cap, and no punitive damages.

Florida rules that apply to you

Your own PIP comes first. If you were in a passenger vehicle, your PIP pays the first bills regardless of fault, up to $10,000, provided you got initial care within 14 days (Fla. Stat. § 627.736). Follow up with a physician, not only a chiropractor, so the emergency medical condition finding is in the chart.

Pain and suffering requires a permanent injury. Fla. Stat. § 627.737(2) sets the threshold. Truck crash injuries, including fractures, spinal injuries and brain injuries, usually meet it, but the doctor has to say so in writing.

Fault is argued hard. Under Fla. Stat. § 768.81(6), you recover nothing if you are found more than 50 percent at fault, and your recovery is reduced by any smaller share. Carriers routinely claim the car cut in front of the truck. The ECM and the camera answer that, which is why preserving them matters.

Insurance is bigger, but not always. Interstate general-freight carriers must carry at least $750,000 in liability coverage under federal rules. Intrastate dump trucks and box trucks may carry far less, and your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 can be the difference in a serious case.

Two years. A negligence suit must be filed within two years of the crash under Fla. Stat. § 95.11(5)(a); wrongful death is two years under § 95.11(5)(e). Government claims need notice under § 768.28(6) first.

FHP, the Sheriff and the report

Interstate and state road crashes in Wesley Chapel are investigated by FHP Troop C, which also has commercial vehicle enforcement troopers who inspect the truck, the driver's logbook and the load. Their long-form report, with diagram and witness list, is valuable. If a Pasco Sheriff's deputy worked a crash on a local road instead, expect a short form with much less detail. Either report is confidential for 60 days except to the parties and their attorneys under Fla. Stat. § 316.066(2). We pull it and we request the inspection report with it.

How we work a Wesley Chapel truck case from Ridge Road

  1. We meet you at AdventHealth Wesley Chapel, BayCare, a Tampa trauma center or your home. No drive to Port Richey.
  2. We send preservation demands to every company on the crash report and every company we find behind it.
  3. We photograph the scene and the vehicles before the truck is repaired and your car is scrapped.
  4. We obtain the FHP report, the commercial vehicle inspection, 911 audio and any plaza or ramp camera footage.
  5. We identify every policy: the carrier's, the owner's, the broker's, and your own UM/UIM.
  6. We let your doctors finish before we put a number on the case, and we file at the Robert D. Sumner Judicial Center in Dade City if the carrier's insurer will not pay what it is worth.

Clementine Conde, a Florida Bar member since 1992, is responsible for every truck case the firm handles. See our truck accident page for the federal hours-of-service rules in detail, and our Wesley Chapel page for the community overview.

Questions people ask us about wesley chapel truck accident cases

The truck that hit me on I-75 was from a company in another state. Can I sue in Pasco County?

Yes. A carrier operating on I-75 through Wesley Chapel is subject to suit in Florida for a crash that happened here, and the case would be filed in Pasco County. Interstate carriers also carry federally required liability coverage, usually at least $750,000 for general freight, which is far more than a typical Florida driver has. The challenge is the carrier's head start: its insurer may have investigators at the scene the same day. Call (240) 421-5511 so our preservation demand reaches them before the electronic logs age out.

A dump truck serving a subdivision off Overpass Road hit my car. Is that a truck case?

It is, and often a more complicated one than an interstate semi. Local haulers may be small companies operating only in Florida under lower insurance minimums, the truck may be leased, and the developer or general contractor that hired the hauler may share responsibility for the schedule or the loading. We identify every company in that chain and every policy behind it, and we check your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 in case the hauler's limits are thin.

Does my PIP pay anything after a truck crash?

If you were in a car, yes. Your own policy pays 80 percent of medical bills and 60 percent of lost income up to $10,000 regardless of fault, as long as you got initial care within 14 days (Fla. Stat. § 627.736). The emergency medical condition finding by a physician, PA or nurse practitioner is what unlocks the full $10,000 instead of $2,500. The claim against the driver and carrier covers everything PIP does not, and the permanent-injury threshold in § 627.737(2) applies to pain and suffering.

Which hospital are Wesley Chapel truck crash victims taken to?

Serious interstate crashes are often flown or driven to a Level I trauma center in Tampa. Less critical injuries go to AdventHealth Wesley Chapel at 2600 Bruce B. Downs Boulevard or BayCare Hospital Wesley Chapel at 4501 Bruce B. Downs Boulevard, which opened in March 2023. HCA Florida Bayonet Point Hospital in Hudson is Pasco's Level II trauma center. We meet clients at any of them.

How long do I have to file a truck accident lawsuit in Florida?

Two years from the crash under Fla. Stat. § 95.11(5)(a) for crashes after March 24, 2023, and two years for a wrongful death claim under § 95.11(5)(e). The deadline that matters more is the one nobody writes down: federal rules let carriers discard hours-of-service records after six months, and engine data can be overwritten the day the truck is repaired.
