A person walking in Land O' Lakes is usually walking along or across US-41. The county complex on Central Boulevard, the plazas at SR-54, the schools along Collier Parkway and the GOPasco stops on Land O' Lakes Boulevard are all reached on foot by people who do not have a car or who left it at home. The road they cross is a four-lane state highway with turn lanes, driveways and signals spaced for traffic flow, not for walking.

Where pedestrians are hit in Land O' Lakes

US-41 between SR-54 and Gowers Corner. The commercial strip, with people crossing mid-block to reach a plaza, a bus stop or a church. Drivers turning right on red are looking left at oncoming traffic, not right at the person in the crosswalk.

SR-54 near Collier Parkway and the Suncoast ramps. Apartment communities on one side of the road, stores on the other, and a signal every half mile or more.

Collier Parkway, Sunlake Boulevard and the school zones. Land O' Lakes High School and the middle and elementary schools along the collectors put children on foot and on bicycles twice a day. School zone limits are posted; not every driver slows for them.

The rural edges. Ehren Cutoff, Parkway Boulevard and the two-lane roads around the lakes have no sidewalks and no lighting, and a person walking the shoulder at dusk is nearly invisible.

The Tampa–St. Petersburg–Clearwater metro, which includes Pasco, ranked eighth most dangerous in the nation for pedestrians in Smart Growth America's Dangerous by Design report released in June 2026, which also ranked Florida the fifth most dangerous state, with 3,726 pedestrian deaths from 2020 through 2024.

Which PIP policy covers a pedestrian

A person on foot was not driving, so the first question is whose no-fault coverage applies.

  • Your household's auto policy. If you own an insured vehicle or live with a relative who does, that policy's PIP covers you as a pedestrian: 80 percent of medical bills and 60 percent of lost income, up to $10,000, regardless of fault (Fla. Stat. § 627.736).
  • The striking vehicle's policy if no one in your household has an auto policy.
  • The 14-day rule. Initial care within 14 days of the crash or the medical benefit is lost.
  • The $2,500 cap. Unless a physician, physician assistant, dentist or nurse practitioner documents an emergency medical condition, PIP medical benefits stop at $2,500. Fractures and head injuries nearly always meet the standard, but someone has to write it down.

PIP does not pay pain and suffering, and $10,000 does not cover an orthopedic surgery. Everything else is a claim against the driver and against any uninsured motorist coverage in your household. Not sure what policies exist in your house? Call (240) 421-5511 and we will find them.

Fault when a car hits a pedestrian on US-41

The driver's insurer will start with where you were crossing. Fla. Stat. § 316.130 does require pedestrians to yield when crossing outside a marked or unmarked crosswalk, to obey signals and to use sidewalks where they exist. It also requires every driver to exercise due care to avoid colliding with any pedestrian, to sound the horn when necessary and to yield in crosswalks.

Florida's modified comparative negligence rule, Fla. Stat. § 768.81(6), then does the math: your recovery is reduced by your percentage of fault and barred if your share exceeds 50 percent. A driver on US-41 who was speeding, on a phone or not watching the road carries fault that offsets a mid-block crossing, and the evidence that proves it is time-sensitive:

  • The vehicle's event data recorder, which captures speed and braking before impact
  • Phone records showing use at the moment of the crash
  • Plaza, gas station and church camera footage along US-41, overwritten within days
  • Lighting, signal timing and the distance to the nearest crossing, which can shift fault toward the road's owner

A dark crossing or a bus stop with no safe way across can make Pasco County or FDOT partly responsible. Those claims are governed by Fla. Stat. § 768.28, with notice before suit and a $200,000 per-person cap, and they add to the claim against the driver rather than replacing it.

What the claim includes

Economic damages. Medical bills from the ambulance forward, future care your doctors project, lost wages and lost earning capacity, and household services you now pay for. Fla. Stat. § 768.0427 limits medical-expense evidence to amounts actually paid or payable under your coverage, so we manage how care is billed from the start.

Pain and suffering. Because the claim is against a motor vehicle owner or operator, Fla. Stat. § 627.737(2) applies: a permanent injury within a reasonable degree of medical probability, significant and permanent scarring, permanent loss of an important bodily function, or death. Pedestrian injuries usually clear the bar; the treating physician's records have to say so.

Hit-and-run. If the driver left, household PIP pays as above, and uninsured motorist coverage under Fla. Stat. § 627.727 treats the unknown driver as uninsured. Report the crash to law enforcement the same day; UM policies require it.

Wrongful death. When a pedestrian is killed, the estate's personal representative brings the claim under Fla. Stat. §§ 768.16–768.26. See our Land O' Lakes wrongful death page.

Who investigates, and how we reach you

Land O' Lakes is unincorporated. FHP Troop C investigates most pedestrian crashes on US-41, SR-54 and SR-52, and a fatal crash gets an FHP traffic homicide investigation. The Pasco Sheriff's Office responds on neighborhood roads; its Public Records Unit is at 20105 Central Boulevard. Crash reports are confidential for 60 days except to the parties and their attorneys under Fla. Stat. § 316.066(2), and we obtain them.

If a lawsuit is necessary, it is filed in Pasco County at the West Pasco Judicial Center in New Port Richey or the Robert D. Sumner Judicial Center in Dade City. Clementine Conde has practiced in Florida courts since 1992 and is responsible for every case.

Our office is at 6609 Ridge Road in Port Richey. The Ridge Road extension now reaches the Suncoast Parkway and Sunlake Boulevard, with the final segment to US-41 scheduled for 2026, and we make the drive to Land O' Lakes for every client who needs us to. See Land O' Lakes for the community overview and our pedestrian accident page for the statewide rules and US-19 corridor data.

Questions people ask us about land o' lakes pedestrian accident cases

My son was hit walking to school near Collier Parkway. Which insurance covers a child?

A child is covered as a pedestrian by the PIP on a parent's auto policy if the child lives in that household, which pays 80 percent of medical bills up to $10,000 regardless of fault. The claim for everything beyond PIP is against the driver, and because a minor's settlement often requires court approval in Pasco County, we handle that step too. A child in a school zone is owed heightened care by drivers, and a school zone speed violation is strong evidence of the driver's fault.

I was hit at a GOPasco bus stop on US-41. Can I make a claim against the county?

Only if the county's conduct contributed, for example a stop placed where no safe crossing exists. Claims against Pasco County fall under Fla. Stat. § 768.28: written notice before suit, a waiting period, and a cap of $200,000 per person. The primary claim is still against the driver who hit you, supported by your household PIP and any uninsured motorist coverage under Fla. Stat. § 627.727. We evaluate both.

The driver says I stepped out between parked cars. Does that mean I get nothing?

No. Fla. Stat. § 316.130 requires pedestrians to yield outside crosswalks, but it also requires every driver to exercise due care to avoid hitting a person on the road. Florida's modified comparative negligence rule, Fla. Stat. § 768.81(6), reduces your recovery by your share of fault and bars it only if you are found more than 50 percent responsible. Speed, phone use and lighting on the driver's side are weighed against where you crossed.

Where are Land O' Lakes pedestrian crash victims treated?

Land O' Lakes has no hospital. Patients go east to AdventHealth Wesley Chapel or BayCare Hospital Wesley Chapel on Bruce B. Downs Boulevard, south to St. Joseph's Hospital-North on Van Dyke Road in Lutz, or west to HCA Florida Trinity Hospital on SR-54. Serious trauma goes to HCA Florida Bayonet Point Hospital in Hudson, Pasco's Level II trauma center, or to a Level I center in Tampa. Tell every provider you were a pedestrian hit by a vehicle.

How long do I have to file a pedestrian claim after a Land O' Lakes crash?

Two years from the crash under Fla. Stat. § 95.11(5)(a) for negligence claims, and two years for wrongful death under § 95.11(5)(e). Claims against the county or FDOT require written notice under § 768.28(6) first. The PIP medical benefit requires initial care within 14 days, and plaza video is overwritten within days, so the deadlines that matter most are measured in days.
